6. Biometric and Personal Data

Palm photographs and birth data may constitute biometric identifiers or sensitive personal information under applicable laws, including the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, the Washington Biometric Privacy Act, the California Consumer Privacy Act, and the EU General Data Protection Regulation. By submitting any palm photograph, you represent and warrant that the photograph depicts your own hands or that you have obtained express written consent from the photographed individual.

7. Third-Party Processing

Your inputs are transmitted to third-party AI service providers for processing. These providers operate under their own terms and privacy practices. Submission of inputs constitutes your consent to such transmission and processing.

8. Eligibility

The Service is intended for users eighteen (18) years of age or older. By purchasing a Reading, you represent that you are at least eighteen years old and have the legal capacity to enter into this Agreement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINGYA TECHNOLOGY LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY READING, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC READING GIVING RISE TO THE CLAIM.

10. Intellectual Property and Personal Use

Readings are licensed to you for personal, non-commercial use only. You may not republish, resell, redistribute, or use any Reading to train any machine-learning system without our prior written consent.

11. No Professional Relationship

No medical, legal, financial-advisory, fiduciary, or therapeutic relationship is created between you and Mingya, or between you and any individual associated with Mingya, by virtue of your purchase or use of a Reading.

12. Indemnification

You agree to indemnify and hold harmless Mingya Technology LLC and its officers, members, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of this Agreement, or your violation of any rights of any third party.

13. Governing Law; Arbitration; Class Action Waiver

This Agreement is governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Agreement or any Reading shall be resolved exclusively by binding individual arbitration administered by JAMS in New York County, New York, in accordance with the JAMS Streamlined Arbitration Rules. YOU AND MINGYA EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction for actual or threatened infringement of intellectual property rights.

14. Changes

We may update this Agreement from time to time. The version posted on our website at the time of your purchase governs that purchase.

15. Severability

If any provision of this Agreement is held unenforceable, the remaining provisions shall continue in full force and effect.
